These Terms of Service (“Terms”) govern your use of the website, Personalized Sleep Plan and AI Sleep Coach (together, the “Services”) provided by Lamplight Baby Sleep, LLC, an Illinois limited liability company (“Lamplight”, “we”, “us”). By purchasing or using the Services you agree to these Terms and to our Disclaimer and Privacy Policy. If you do not agree, please do not use the Services.
1. What the Services are
The Services provide parenting education, comfort techniques and homemaking guidance relating to infant and toddler sleep. They are not medical advice, diagnosis or treatment and do not replace the care of a licensed healthcare provider. You agree to follow your child’s pediatrician’s guidance and current safe-sleep recommendations at all times, and to seek medical care for any health concern.
2. Eligibility
You must be at least 18 years old and the parent or legal guardian of the child, or acting with the parent’s or guardian’s permission. The Services are intended for families in the United States.
3. Purchases, subscriptions and cancellation
The Personalized Sleep Plan is a one-time purchase at the price shown at checkout. The AI Sleep Coach is a monthly subscription at the price shown at checkout. When you purchase a Plan, a Coach subscription begins at the same time with an introductory free period as stated at checkout, after which it renews monthly until cancelled. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period. Payments are processed by Stripe under its own terms; we do not store your card details. Prices are in US dollars and may change with notice for future purchases.
4. Refunds
Our Refund & Cancellation Policy forms part of these Terms.
5. Your account and your answers
You are responsible for the accuracy of the information you provide in the questionnaire and to the coach, and for keeping your sign-in links private. Plans are written from your answers; incomplete or inaccurate answers will produce a less suitable plan. Do not share sensitive information about other people without their permission.
6. Acceptable use
You may use the Services for your own family’s personal, non-commercial use. You may not resell, redistribute or publish plans or coach conversations; attempt to extract our instructions, prompts or research library; use the Services to harm anyone; or attempt to interfere with the Services’ operation or security.
7. Intellectual property
The Services, including the website, plan structure, coach instructions, research library and branding, are owned by Lamplight and protected by copyright and trademark law. Your plan is licensed to you for personal use. Feedback you give us may be used to improve the Services without obligation to you.
8. Automated services
The AI Sleep Coach is automated and plans are drafted by automated means before human review. Automated outputs can contain errors. We use reasonable efforts, including strict rules and human review of plans, but we do not warrant that any output is accurate, complete or suitable for your circumstances. Do not use the coach in an emergency.
9. Disclaimer of warranties
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and any warranty of results.
10. Limitation of liability
To the fullest extent permitted by law, Lamplight and its members, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss, injury or damage arising from your use of or reliance on the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, in which case they apply to the extent permitted.
11. Indemnity
You agree to indemnify Lamplight against claims arising from your breach of these Terms or your misuse of the Services.
12. Changes and termination
We may update the Services or these Terms; material changes will be posted here with a new date. We may suspend or terminate access for breach of these Terms. You may stop using the Services at any time.
13. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in McLean County, Illinois, and you consent to their jurisdiction.
